Que poderes terá Sergio Moro contra a corrupção como ministro da Justiça?

Sergio Moro, como juiz da 13ª vara de Curitiba, se notabilizou pelo combate à corrupção.

Ele condenou e prendeu importantes empresários e lideranças políticas, entre elas o ex-presidente Luiz Inácio Lula da Silva.

A partir de 2019, Moro vai ser Ministro da Justiça do governo Bolsonaro e o combate à corrupção será uma agenda central de sua gestão.

Sou Mariana Schreiber, correspondente da BBC News aqui em Brasília, e fiz uma matéria, que a gente está publicando no nosso site, sobre o que, afinal, Moro pode fazer para combater a corrupção, fortalecer o combate à corrupção, no Ministério da Justiça e que desafios ele pode ter nessa tarefa.

Eu vou falar um pouquinho nesse vídeo sobre o que eu apurei nessa reportagem em cinco pontos.

Vou tentar resumir pra vocês, então, quais são essas oportunidades que ele vai ter como Ministro da Justiça e os desafios que também enfrentará nessa agenda de combate à corrupção.

* O 1º ponto que queria destacar para vocês é o que ele apontou como a primeira ação que ele vai adotar nessa área.

Sergio Moro, em conversa com jornalistas, já indicou que logo no início da sua gestão, ele quer logo enviar ao congresso um pacote de propostas de mudanças na legislação que podem favorecer o combate à corrupção.

A gente sabe que quem muda lei é o Congresso, mas o governo federal pode enviar propostas de lei.

Em geral, quando o governo encaminha propostas, patrocina, realmente faz uma campanha mais forte por determinadas propostas, o governo federal costuma conseguir fazer com que o Congresso priorize essas pautas e também dê mais agilidade à tramitação dessas propostas.

Então, o juiz Sergio Moro, não mais juiz no próximo ano, o Ministro vai poder utilizar essa força do governo federal e também do próprio simbolismo que ele tem é como uma autoridade nesse tema e para poder fazer avançar essas pautas.

A gente lembra que, em 2016, o Ministério Público Federal encaminhou ao Congresso um pacote de medidas, que ficou conhecido como "10 medidas contra a corrupção".

Esse pacote foi desfigurado na Câmara e empacou no Senado.

Daí o juiz Sergio Moro, então, vai ter o desafio de dar um fim diferente para esse pacote, tentar aprová-lo.

Eu conversei pouquinho com alguns especialistas nessa área, por exemplo, Fabiano Angélico, que é consultor sênior da Transparência Internacional, e Michael Mohallem, que é professor da FGV.

Ambos participaram da elaboração de um pacote de propostas, que se chama "Novas medidas contra a corrupção" e o juiz Sergio Moro foi fotografado segurando este livro, quando ele foi se reunir com Bolsonaro.

Então esses dois professores, especialistas com quem conversei, consideram que o Sergio Moro pode ter mais sucesso na aprovação desses pacotes.

Na visão do Fabiano Angélico, justamente esse simbolismo que ele tem dá mais peso, traz mais visibilidade, e o fato de ele ser um técnico reconhecido nessa área pode favorecer, então a aceitação dessas propostas.

Por outro lado, o que diz o Mohallem, da FGV, é que o pode também facilitar a aprovação é se o juiz Sergio Moro buscar um pacote, uma proposta mais consensual.

O pacote de 10 medidas não foi adiante também porque era polêmico.

Ele gerou reação de parte da comunidade jurídica.

Por exemplo, uma das propostas era de restrição ao habeas corpus, que é um instrumento que visa a reverter prisões consideradas ilegais ou abusivas.

E na proposta encaminhada ao Ministério Público Federal, o habeas corpus seria restringido.

Isso gerou muita reação.

Na visão do Michael Mohallem, da FGV, vai ser muito importante o que Moro vai colocar nesse pacote para encaminhar ao Congresso.

Algumas propostas que o Moro já disse que quer ver nesse pacote é, por exemplo, mudanças na prescrição dos crimes.

O que acontece é que quando uma pessoa comete um crime, se demora muito tempo para o processo terminar, pode ser que esse crime prescreva, ou seja, que a sua punição fique extinta.

No caso da corrupção passiva, esse pode variar de 4 a 6 anos, o prazo de prescrição, a depender da gravidade do crime e da pena que for fixada ao fim do processo.

Uma das propostas é essa Outra, Moro também que gostaria que o Congresso deixasse mais claro na Constituição a possibilidade de prisão após 2ª Instância.

Isso hoje depende na interpretação do Supremo Tribunal Federal e isso tem variado.

O Supremo Tribunal tem mudado de posição ao longo do tempo e há uma expectativa de que possa vir a mudar novamente, revertendo a autorização que foi dada em 2016 para que presos pessoas condenadas em 2ª Instância, possam já ser presas mesmo restando recursos a cortes superiores.

Esse foi o primeiro ponto que destaquei na matéria, de como Moro pode contribuir no combate à corrupção, agora não mais como juiz, mas como Ministro, é justamente patrocinando e usando seu prestígio para tentar avançar com essa pauta legislativa.

Qual é o segundo ponto?

* Segundo ponto é uma questão mais administrativa que está na mão do Moro, que seria o fortalecimento da Polícia Federal.

Conversei com a Associação de Delegados da Polícia Federal.

O Edivanir Paiva, que é presidente dessa associação hoje, e há uma expectativa de que Moro nomeie como diretor geral e também como superintendente delegados técnicos e comprometidos com o combate à corrupção, bons nomes nessas áreas.

O próprio Bolsonaro já disse que dará total autonomia para o Moro definir esses nomes, porque não é uma decisão apenas do Ministério da Justiça: ela passa pela Presidência, mas Bolsonaro se comprometeu que Moro terá essa autonomia.

É justamente essa força que Moro tem, a popularidade, garante que ele vai ter essa autonomia concedida pelo presidente Bolsonaro.

Então, há essa expectativa enquanto à nomeação e também quanto ao orçamento.

O orçamento da Polícia Federal é fixado pelo governo federal, enviado ao Congresso, e tem que ser aprovado lá.

Está havendo uma crise fiscal, há muita disputa de recursos, a Polícia Federal tem sofrido contingenciamento, como outros órgãos.

Mas a expectativa da associação dos delegados da Polícia Federal é que Moro, com seu prestígio, também consiga nessa batalha trazer mais recursos para a Polícia Federal poder investir em tecnologia, em operações e também recuperar seu efetivo.

O efetivo da Polícia Federal tem caído nos últimos anos, porque vem ocorrendo naturalmente aposentadorias e, por causa dessa crise fiscal, não tem sido realizados concursos para repor o efetivo da Polícia Federal, assim como também tem ocorrido em outros órgãos.

* O terceiro ponto que Moro pode atuar, segundo especialistas e autoridades com quem eu conversei, é a questão da coordenação, articulação com outros órgão.

O combate à corrupção não depende apenas do Ministério da Justiça, ele passa pela atuação do Ministério da Transparência e Controladoria Geral da União, que é a CGU, passa pelo Tribunal de Contas da União, que é ligado ao Legislativo; pelo Ministério Público Federal, que é ligado ao Judiciário; Receita federal, por exemplo.

São vários órgãos.

Só que o Ministério da Justiça tem uma função de articulação importante.

Por exemplo, tem uma instituição que chama ENCCLA, que é um órgão formado para estratégias de combate à corrupção, que reúne mais de 60 órgãos não só do governo federal, mas dos governos estaduais.

Ele fica sob coordenação do Ministério da Justiça.

É um órgão de elaboração também de medidas anticorrupção e, enfim, há muitas formas de corrupção.

Foi também algo que surgiu nas entrevistas que eu fiz.

Por exemplo, Torquato Jardim, que é o Ministro da Justiça e já foi também ministro da CGU no governo Temer, destacou que um dos problemas sérios no Brasil é o desvio de recursos em Estados e municípios, de recursos repassados pelo governo federal.

Isso apareceu não só nessa entrevista, mas também com a subprocuradora geral da república Luiza Frischeisen, com quem conversei, que coordena a Câmara Criminal da PGR, e também os especialistas em corrupção, como o professor que já citei, Michael Mohallem, da FGV.

Eles destacaram que o Moro terá um papel de articulação para conseguir fortalecer o combate à corrupção espalhado pelo Brasil, que é diferente da corrupção que ele tratou na Lava Jato, que envolvia desvios de estatais, ligadas ao financiamento de campanha.

É o tipo de corrupção mais espalhado, em operações menores, mas que estão espalhadas por 5 mil prefeituras.

É tão difícil combater.

Por exemplo, que tipo de propostas vêm nessa área?

O pessoal da FGV e da Transparência Internacional sugere, por exemplo, que seria importante criar um selo do governo federal de boa conduta para as prefeituras.

Prefeituras que adotassem práticas de transparência e de boa gestão dos recursos públicos, que facilitariam a prevenção e a fiscalização da corrupção, eles poderiam adquirir esse selo para prefeitos.

Seria ótimo para a imagem deles, para melhorar a resposta junto aos seus cidadãos do município, mostrar avanço na sua prefeitura, e poderia estimular a adoção de boas práticas de combate à corrupção.

Isso estaria muito ligado ao trabalho que a CGU faz: fiscaliza esses repasses de recursos para municípios.

Mas, na visão dos especialistas com quem conversei, o Sergio Moro, com seu prestígio, ele pode participar da elaboração dessa proposta e da sua implementação.

Então, já temos 3 pontos que listei como contribuições que Sergio Moro poderá dar como Ministro da Justiça.

Recapitulando: propostas de leis, o fortalecimento da Polícia Federal, fortalecer a articulação entre órgãos.

* E um quarto ponto que os entrevistados destacaram é o poder que o governo tem, que o presidente da República tem, na nomeação de juízes tanto para os recursos superiores quando para os Tribunais Regionais Federais, os desembargadores.

A gente sabe que a carreira de juiz começa com um concurso público.

O juiz Sergio Moro passou no concurso público e assim assumiu essa vara em Curitiba, mas na 2ª e 3ª Instâncias, que são os tribunais regionais federais que vão revisar as decisões da 1ª Instância, no Superior Tribunal de Justiça, o Supremo Tribunal Federal, essas nomeações passam por indicação do Presidente da República.

E o Presidente da República não tem tempo de pensar nas funções de nomeações, que são centenas de cargos, então o ministro da Justiça tem um papel muito importante de aconselhar para a escolha desses cargos.

O Michael Mohallem, que é o professor da FGV que já citei aqui, foi consultor jurídico do Ministério da Justiça no governo Lula e me falou que, de fato, é muito importante o papel do Ministro da Justiça na definição desses nomes.

O que o Moro poderá fazer?

Ele provavelmente vai optar por nomes mais alinhados com seu entendimento jurídico.

Existem diferentes correntes jurídicas.

Por exemplo, há juízes mais garantistas, que esse nome vem da garantia de direitos, são juízes que dão mais peso para as garantias constitucionais dos acusados.

Por exemplo, esse juízes, eles não concordam, eles se opõem à prisão após a 2ª Instância.

É uma das defesas do Moro, por exemplo, conduções coercitivas, que o Moro adotou na Lava Jato, acabaram proibidas pelo Supremo Tribunal Federal, Juízes mais garantistas não adotam esse tipo de prática.

O juiz Sergio Moro, como Ministro da Justiça, vai poder aconselhar o Presidente da República na nomeação desses desembargadores de Tribunais Regionais Federais, os Ministros das Cortes Superiores, para que nomes mais alinhados com o que ele acredita serem os melhores procedimentos jurídicos sejam nomeados.

Não é que o Presidente da República terá liberdade total.

Desses desembargadores, geralmente, ele tem que escolher três numa lista tríplice encaminhada pelos Tribunais, no caso dos cursos superiores a nomeação passa pelo Senado também, mas ele tem algum tipo de capacidade de influir na escolha desses nomes.

E o ponto que eu queria trazer para vocês, na verdade, mais um desafio: Moro vem com essa agenda forte de combate à corrupção.

Ele basicamente usa isso para justificar o fato de ter aceitado um convite que foi controverso.

Algumas pessoas o criticaram por ter aceitado isso, aceitado virar Ministro da Justiça, porque entenderam que isso poderia criar uma pecha de parcialidade no trabalho dele na Lava Jato.

O PT tem feito muito essa crítica, mas o juiz Sergio Moro rebate essas críticas, dizendo que ele aceitou esse convite justamente porque via muitas ameaças à Lava Jato.

Ele entendeu que, como Ministro da Justiça, vai poder implementar uma agenda que fortalecer o combate à corrupção e evite retrocessos.

Então ele chega com essa agenda forte de corrupção, mas não é único tema que ele vai tratar:.

* ...esse é o quinto ponto que eu destaco nessa reportagem, o fato do Ministério da Justiça tratar de muitos assuntos.

Outro assunto muito importante será a crise na segurança pública, que também vai ser uma prioridade da gestão dele.

A gente está com uma crise séria.

O Brasil atingiu um recorde de mais de 60 mil homicídios ao ano.

Ele vai ter que, ao mesmo tempo, cuidar da corrupção, cuidar de outros temas e isso pode dificultar os avanços nas mais diversas áreas, porque é muito problema para resolver.

Um assunto pode eclipsar outro.

Problema de recursos também, se vai priorizar o combate à corrupção, priorizar o combate à crise de segurança pública.

Tem problema sério dos presídios, que estão superlotados e isso também passa pelo Ministro da Justiça, a gestão nessa crise dos presídios.

Tem outro tema espinhoso que vai estar na mesa do juiz Sergio Moro, e vai dividir a atenção dele: a questão da demarcação das terras indígenas, que gera muita tensão entre povos indígenas e geralmente produtores rurais.

O presidente Bolsonaro já disse que não quer mais nem um centímetro de terras para indígenas, mas a Constituição Federal prevê a demarcação de terras indígenas, e isso é uma atribuição do Ministério da Justiça, assim como, por exemplo, também a crise de refugiados.

Essa questão da migração também está sob a pasta do Ministério da Justiça.

A gente sabe que é uma crise grave, com a entrada de venezuelanos em massa em Roraima, que é um Estado que não está dando conta de atender esse fluxo grande de imigrantes.

Então, espero que tenha ajudado um pouquinho a explicar melhor para vocês quais são as possibilidades que Moro vai ter para fortalecer o combate à corrupção, de fato, no Ministério da Justiça, para cumprir essa promessa dele, esse objetivo de fortalecer o combate à corrupção, mas também quais são os desafios que vão ter pelo caminho para ele conseguir levar adiante essa agenda.
