A: Why are Chinese judges so young? In the United States, judges are all experienced and respected figures.
B: It's all about the legal systems of the two countries.
Chinese law belongs to the civil law system, also called statutory law.
That is to say, all laws are written one by one through legal texts.
The U.S. legal system is completely different.
It is part of the common law system, also known as case law.
It is based on the decision of a judge or jury.
In this way, the judge has greater autonomy to decide each case on its own merits.
That is why judges in the United States generally require very strong qualifications.
A: Oh, so that's it.
Well, do they have juries in China?
B: China also has a jury system called People's Jurors.
However, their role is very different from that of a jury in the United States.
In the United States, the role of the jury is enormous.
They can decide on the final judgment.
It is also an important safeguard for the maintenance of justice.
In the common law system, there is a clear division of labor between the jury and the judge.
The former is responsible for determining the facts of the case, while the latter is responsible for applying the law.
If the jury finds the defendant not guilty, the judge immediately acquits him and releases him from custody; if he finds him guilty, the judge sentences him according to the law.
A: And don't jurors in China have a role in that?
B: They do not decide on the sentence, but try the case with the judge.
China's jury system is designed to analyze cases from different perspectives, allowing judges to listen to the opinions of people from outside the profession and enrich their thinking and judgment.
At the same time, judges are supervised and bound.
A: Listening to you, I think China's legal system believes in written rules, and emphasizes checks and balances.
The United States, on the other hand, focuses more on the rights of the individual.
But I'm curious about the role of lawyers.
Since the role of judges and jurors is not very important in China, what is the use of lawyers?
B: I once heard an American say: "You have a good lawyer, you have the best legal system in the world.
"In the United States, lawyers can persuade jurors with past cases, courtroom presentations, and vigorous defenses.
What a Chinese lawyer can do is to speak out the legal provisions he has learned one by one.
Then find the possibility of mitigating the crime of the parties from these legal provisions.
Because all the sins are stipulated, there is really very little he can do unless he can find evidence against them.
A: So, the two legal systems are really quite different.
Oh, it's getting late, I've got to get going.
Next time I have a chance, I will ask you for legal advice.
I am quite interested in this area.
B: Please forgive me.
I just showed you these two brushes today.
