Utilitarismo

É no domínio das teorias da obrigação que a DDE se situa.

Neste domínio a questão fundamental é a de saber o que torna as acções certas ou erradas. Como já ficou claro, os consequencialistas respondem a esta questão dizendo que só as consequências das acções determinam a sua correcção moral. Pensam que fazer o que está certo é apenas uma questão de promover aquilo que é bom ou tem valor. Muitas vezes vão mais longe e defendem que a nossa obrigação básica é levar ao limite essa promoção — devemos maximizar o bem, dar origem aos melhores estados de coisas. O utilitarismo é a forma mais influente de consequencialismo. Embora os utilitaristas divirjam profundamente entre si, sobretudo por subscreverem diferentes teorias do valor, têm em comum pelo menos isto: pensam que a avaliação dos estados de coisas deve ser feita de uma perspectiva estritamente imparcial, definida pela atribuição do mesmo peso aos interesses de todos sujeitos que serão afectados pelo que fizermos. À luz do utilitarismo, bem como do consequencialismo em geral, certas distinções proeminentes na filosofia moral não têm relevância ética básica. Dado que o único padrão para avaliar a conduta é o bem ou o mal prováveis que podem resultar do comportamento, a distinção fazer/permitir não tem em si qualquer peso moral: provocar um mal não é pior nem melhor que permitir que esse mesmo mal se verifique. O mesmo se pode dizer da distinção directo/mediado: dar origem a um mal sem a intervenção de mais ninguém não é significativamente diferente de fazer algo que levará outros agentes a dar origem a esse mesmo mal. E a distinção que mais no interessa, a distinção intenção/previsão, não recebe um tratamento mais favorável no utilitarismo. Cada uma destas três distinções é excluída pela mesma razão: a única obrigação moral é contribuir para a realização de estados de coisas valiosos; o modo como um agente contribui para tal realização não pode tornar uma acção certa ou errada. Por isso, a diferença entre pretender um mal e prevê-lo enquanto simples resultado daquilo que pretendemos é algo que por si nunca pode determinar o que é permissível fazer. A este nível a incompatibilidade entre o utilitarismo e a DDE não podia ser mais clara, mas, como tentarei agora mostrar, um utilitarista pode (e talvez deva) encontrar um lugar para o duplo efeito na sua teoria. O utilitarismo é primariamente uma teoria sobre o que torna as acções certas ou erradas. Enquanto tal nada nos diz sobre deliberação moral, embora nos possa parecer que a esse respeito implica algo como o seguinte: para decidir o que fazer devemos identificar os cursos de acção disponíveis, determinar as boas e más consequências de cada curso de acção, e optar por aquele que, ponderadas as probabilidades, promete dar origem ao melhor estado de coisas. De facto, um utilitarista que reconhecesse um único nível de pensamento moral defenderia que todas as nossas decisões deveriam ser tomadas desta maneira — deveríamos pensar como um utilitarista em todas as circunstâncias, estando permanentemente empenhados na promoção imparcial do bem. Mas é óbvio que, dadas as nossas limitações cognitivas e a nossa constituição psicológica, um tal utilitarismo de único nível derrotar-se-ia a si próprio, pois qualquer ser humano que o levasse a sério ver-se-ia quase paralisado por intermináveis estimativas de consequências que, aliás, não deixariam de ser influenciadas por considerações egoístas, o que se tornaria muito perigoso aliado à total indiferença às regras morais comuns. A história do jovem Raskolnikov, protagonista de Crime e Castigo, proporciona-nos um exemplo inesquecível deste perigo. Dado que ter o pensamento dominado exclusivamente por raciocínios utilitaristas é uma péssima maneira de promover imparcialmente o bem, qualquer versão credível do utilitarismo tem de encontrar lugar para vários níveis de pensamento moral. O utilitarismo de dois níveis desenvolvido por R. M. Hare (1981) é a este respeito a teoria mais influente. Hare defende que o nosso pensamento deve permanecer quase sempre no nível intuitivo: em vez de nos deixarmos enredar em cálculos fúteis e enganadores, devemos tomar decisões seguindo simplesmente as nossas intuições morais — que se exprimem em muitas das regras morais comuns —, bem como cultivar o nosso carácter desenvolvendo certas disposições para agir que em geral se revelam benéficas. Só quando se gerar um conflito neste nível — o que pode acontecer quando as regras morais colidem — é que devemos, se as circunstâncias o permitirem, ascender ao outro nível de pensamento: o nível crítico. Neste nível de pensamento moral o que fazemos é raciocinar de uma forma manifestamente utilitarista, o que é necessário não só para resolver conflitos no nível intuitivo, mas sobretudo para decidir que intuições e disposições nele devemos adoptar. O utilitarismo tem assim relevância prática significativa não enquanto guia na vida quotidiana, mas enquanto padrão para avaliar criticamente práticas controversas como a eutanásia, a exploração de animais, a acção afirmativa ou o consumo de bens supérfluos. Podemos agora interrogar-nos se um utilitarista, mesmo excluindo a DDE do pensamento crítico, tem boas razões para incluir de alguma maneira a doutrina entre as intuições e disposições que devem ser adoptadas no nível intuitivo. Quanto à ideia de que é errado pretender o mal enquanto fim, em função de si mesmo, a resposta só pode ser afirmativa: a malevolência é uma disposição que o utilitarista deverá querer desencorajar fortemente, já que pelo menos neste mundo os agentes malévolos tendem a não promover o bem. E a ideia de que é errado pretender o mal enquanto meio para o bem? Terá o utilitarista alguma razão para aceitar esta ideia no nível intuitivo, ou seja, para dizer que devemos cultivar uma relutância mais forte em pretender o mal enquanto meio do que em dar origem ao mal enquanto efeito meramento previsto? Um argumento de J. L. Mackie (1977: 162-3) leva a pensar que sim. Confrontado com um par de situações idealizadas em que o agente, por exemplo, salva várias pessoas provocando a morte de uma — como o par Transplante/Trólei —, o utilitarista não vê qualquer diferença relevante entre essa morte ser pretendida enquanto meio e ser meramente prevista enquanto efeito lateral do meio. Mas na vida real as coisas passam-se de maneira muito diferente, pois os agentes têm de lidar frequentemente com grandes incertezas quanto ao que resultará daquilo que fizerem. E há razões para crer que em geral a ocorrência de um mal é mais provável quando este é pretendido enquanto meio do que quando este é meramente previsto enquanto efeito lateral do meio. Numa versão um pouco mais realista do Trólei, o mau efeito não seria inevitável: haveria uma certa probabilidade de o trabalhador fugir a tempo. Por isso, na ponderação dos custos e benefícios de desviar o trólei, teríamos que reduzir o peso do mau efeito tendo em conta essa probabilidade. Mas quando, como no Transplante, o mau efeito é pretendido como meio para o bom, não se pode fazer uma redução semelhante, pois como a morte do paciente é o meio escolhido para salvar os outros, o cirurgião não pode atingir o seu fim sem que essa morte se verifique. Como Mackie observa, "se há um mal que só pretendemos obliquamente, que aceitamos como efeito lateral, podemos ainda esperar que este não se verifique — ou, se tivermos crenças religiosas, rezar para que não se verifique ou confiar na intervenção de Deus. Mas seria absurdo termos uma destas atitudes em relação àquilo que pretendemos directamente, enquanto meio para o fim que escolhemos. " Nestas circunstâncias, declara Mackie, embora o utilitarista não possa dar menos importância aos efeitos laterais dos meios enquanto tais, deve reconhecer que a relutância em usar um mau meio pode ser em geral mais benéfica que uma relutância similar em tolerar um mau efeito lateral. E assim a distinção intenção/previsão acaba por ser significativa no nível intuitivo. Por razões semelhantes, também as distinções directo/mediado e fazer/permitir têm peso nesse nível.
